Section 501(c)(3) of the Tax Code is the section that describes
\ncharitable organizations that are exempt from paying federal income
\ntax.\u00a0 Section 508 of the Code requires any organization created after
\nOctober 9, 1969 that seeks 501(c)(3) charitable exemption to notify the
\nInternal Revenue Service and apply to obtain an official recognition,
\nbut exempts from the filing requirement those organizations described in
\n Section 508(c).\u00a0<\/p>\n

Section 508(c)(1) exempts in subsection (A) churches, their
\nintegrated auxiliaries, and conventions or associations of churches,
\nwhile subsection (B) exempts charities that are not private foundations
\nand normally have gross receipts of not more than $5000 a year.<\/p>\n

The religious organizations mentioned in (A) are also exempt from
\nfiling an annual Form 990 series tax information return.\u00a0 The small
\nnonprofits that don\u2019t have to file for recognition of exemption under
\n508(c)(1)(B) nevertheless have to file a tax information return,
\nnormally the Form 990-N electronic postcard.\u00a0 They will automatically
\nlose their exempt status (even though the IRS may not know that they
\nexist) if they fail to file for three consecutive years.<\/p>\n

The
\n 508(c)(1)(a) Faith Based Organization (FBO) is a religious, non-profit,
\n tax exempt organi-zation.\u00a0 The 508(c)(1)(a) FBO is separate and
\ndistinct from a 501(c)(3) charity and unincorporated FBO\u2019s.\u00a0 The
\n508(c)(1)(a) is applicable in all 50 states and recognized
\ninternationally under the Hague Convention of the United Nations
\nCharter.<\/span><\/span><\/span><\/span><\/p>\n

Since
\n its inception in 1954 with the Johnson Amendment, the 501(c)(3) has
\nbeen promoted and advertised by many as the only option to organizing a
\nFBO. This is fatally incorrect. \u00a0Federal law, IRS publications, and
\ncourt cases all confirm and establish the rights and protection of the
\n508(c)(1)(a) FBO.\u00a0<\/span><\/span><\/span><\/span><\/p>\n

The
\n 508(c)(1)(a) FBO enjoys a \u201cmandatory exception\u201d from all the
\nrestrictions a 501(c)(3) FBO has including free speech restrictions, IRS
\n reporting requirements, rules and regulations that the IRS may from
